Welcome to Travel by Theresa.
These Terms and Conditions ("Terms") govern your use of our website and the services provided by Travel by Theresa ("we," "us," "our"). By accessing or using our website, you agree to comply with these Terms. If you do not agree with these Terms, please do not use our website. By planning travel with Travel by Theresa, you agree to be bound by these terms and acknowledge that Travel by Theresa acts solely as a booking agent for disclosed principal supplier tour operators, cruise lines, hotels, bus companies, ground transportation, boat purveyors or owners, and other independent contractors providing accommodations, transportation, and other services (“Supplier(s)”) and is not the source or provider of the travel services.

1. Services
Travel by Theresa provides travel-related services, including but not limited to booking accommodations, flights, tours, and other travel experiences. All services are subject to availability and may change without notice.
Travel by Theresa is an independent contractor with FORA Travel, Inc.

2. User Information

To access certain services of our website, you may be required to provide account information. You agree to provide accurate and complete information during the registration process and to update your information as necessary.

3. Booking and Payments

Prices are subject to change until a booking is confirmed. Payment must be made in full at the time of booking unless otherwise specified. Any applicable taxes, known fees, or charges will be added to the total price at checkout.

Travel by Theresa accepts all bookings solely as the booking agent for the travel Suppliers on your itinerary. Separate Supplier terms and conditions will apply to your reservation and purchase of travel-related goods and services that you select, and you understand and agree that by booking travel through Travel by Theresa, you are also agreeing to the booking terms of each Supplier partner you have selected for your itinerary. You agree that you will abide by the terms and conditions of purchase imposed by any Supplier that you have selected as a service provider on an itinerary you have approved.

Travel by Theresa is not liable or responsible for any arrangements made independently of Travel by Theresa. Travel by Theresa assumes no responsibility for costs or fees you incur for independent arrangements not booked through Travel by Theresa, including but not limited to, airline, hotel, excursion, and travel protection related charges. If you make your own flight arrangements, Travel by Theresa is not responsible for any loss resulting from cancellations or changes in travel plans, itineraries or travel dates.

4. Payments, Cancellations, Changes to bookings and Refunds

You are fully responsible for all charges, fees, duties, taxes, and assessments that arise from your travel bookings made through Travel by Theresa. By submitting a credit card authorization form to Travel by Theresa, you authorize us to use your payment method to purchase travel products from our Suppliers on your behalf.

Please note that all planning fees are non-refundable.

All payments for travel services must be completed before departure according to each Supplier’s specific terms and conditions. It is important to review the cancellation policy for each booking carefully before finalizing your reservation. You acknowledge that failure to make final payment or any violation of a Supplier’s terms may result in the cancellation of your reservations, denial of access to flights, tours, hotels, cruises, or other travel services, and the forfeiture of any payments made. In some cases, there may be NO REFUND once a booking is made and a deposit is paid. You may not be eligible for a refund if you change or cancel your travel plans after your booking is confirmed. All cancellation requests must be submitted to Travel by Theresa in writing. Cancellation penalties from both Travel by Theresa and third-party Suppliers will apply. These fees will be charged to the payment method you authorized for your travel services or deducted from any refunds issued by the Supplier.

If you wish to modify any part of your confirmed arrangements before departure or during your trip, we will make every effort to assist you. However, some bookings may be non-changeable, and you will be responsible for any additional costs imposed by the Supplier, as well as any change fees charged by Travel by Theresa or the Supplier. All requests for booking changes must be submitted in writing to Travel by Theresa.

5. Travel Documentation

It is the Client's responsibility to obtain and carry a valid passport, visa(s), and any other necessary travel documents. Travel by Theresa is not liable for any losses or delays due to insufficient or incorrect travel documentation.

Please be aware that some countries will deny entry if your passport is set to expire within six (6) months of your scheduled return date. Non-U.S. citizens may need additional documentation, and you must inform Travel by Theresa if you are traveling on a passport from a country other than the United States. Travel by Theresa has no control over the issuance of visas or visa waivers, and cannot guarantee their approval. If a visa is not issued, Travel by Theresa is not responsible for any payments lost toward your trip. Please note that entry and exit requirements for each country can change at any time.

Children and infants may also require specific travel documents. Minors traveling with only one parent, or without both parents, may be denied entry unless they have authenticated and verified consent forms; for more information, visit https://help.cbp.gov.

The name, date of birth, and gender on your identification must exactly match the details on your tickets and booking records. It is your responsibility to ensure that all information on your tickets and confirmations is correct. Any discrepancies between your reservation and your travel documents may result in denied boarding or delays at airport security, which could cause you to miss your flight or other scheduled travel arrangements.

WHEN YOU RECEIVE YOUR TRAVEL DOCUMENTS, YOU MUST REVIEW AND VERIFY ALL INFORMATION FOR ACCURACY. CONTACT TRAVEL BY THERESA IMMEDIATELY IF ANY CHANGES OR CORRECTIONS ARE NEEDED. IF YOU DO NOT INFORM US OF NECESSARY CORRECTIONS WITHIN TWENTY-FOUR (24) HOURS OF RECEIVING YOUR DOCUMENTS, TRAVEL BY THERESA WILL NOT BE RESPONSIBLE FOR ANY ADDITIONAL COSTS INCURRED TO MAKE CORRECTIONS.

6. Travel Insurance

Travel by Theresa offers access to travel insurance to help protect travelers and their investment in travel. Unless specifically noted, travel insurance is not included in the cost of your itinerary. Travel insurance can provide coverage for various situations, including third-party Supplier default or bankruptcy, delays, interruptions, missed cruise connections, cancellations, medical emergencies, transportation/evacuation and repatriation, baggage and personal effects, lost luggage, baggage delays, illness, job loss, change of plans, accidental death and disability, travel accidents, sickness, medical expenses, and more. Proper insurance may protect you from financial loss in many circumstances.

Without appropriate travel insurance, you acknowledge and agree that if you cancel or interrupt your travel for any reason, portions of your trip or tour may not be refunded, and both Travel by Theresa's and the travel Suppliers' cancellation penalties will apply, potentially resulting in the loss of the full cost of your travel booking and related expenses. The purchase of travel insurance is not required to purchase any other product or service offered by Travel by Theresa.

Please note that Travel by Theresa is not a licensed insurance broker, and its advisors are not qualified or authorized to answer technical questions about benefits, exclusions, or conditions of any offered insurance, nor to evaluate the adequacy of your existing insurance coverage. An additional charge applies for any travel insurance you select. It is your responsibility to understand what your insurance policy covers and to arrange alternative coverage if you wish to insure against conditions excluded by your policy.

7. Limitation of Liability

Travel by Theresa operates solely as a booking agent for the disclosed principal Suppliers and is not the provider or source of any travel services. Each Supplier is an independent entity with its own management and is not controlled by Travel by Theresa. The Suppliers named in your travel documents are responsible for delivering the travel services you have purchased, and by proceeding, you consent to their use.

Suppliers may make changes to the itinerary for various reasons, including but not limited to severe weather conditions. Any such changes are at the sole discretion of the Supplier, and Travel by Theresa is not responsible for these alterations.

As Travel by Theresa acts as an agent for the disclosed principal Suppliers and does not have control over their operations, you agree that Travel by Theresa is not liable for any personal injury or property damage that may result from the services provided. Travel by Theresa hereby disclaims any liability, whether based on contract, tort, strict liability, or otherwise, including but not limited to liability for any direct, punitive, special, consequential, incidental, or indirect damages related to the goods or services provided by any Supplier booked through Travel by Theresa. This includes, without limitation, any liability for acts, errors, omissions, injuries, losses, accidents, delays, or irregularities caused by the fault, negligence, willful acts, omissions, or otherwise of such Suppliers or their employees, agents, servants, or representatives. This also includes, without limitation, issues related to non-delivery or inadequate delivery of services, cancellation and refund policies, fuel increases, bankruptcy, cessation of operations, and other matters beyond the control of Travel by Theresa. You hereby release Travel by Theresa from any liability in connection with these matters.

8. Third-Party Links
Our website may contain links to third-party websites or services that are not owned or controlled by us. We are not responsible for the content, privacy policies, or practices of any third-party websites. You acknowledge and agree that we are not liable for any damage or loss caused by your use of any third-party websites or services.

9. Changes to These Terms
We reserve the right to modify or update these Terms at any time without prior notice. Your continued use of our website following any changes constitutes your acceptance of the revised Terms.

10. Governing Law

These Terms and Conditions are governed by the laws of the State of New Jersey. By booking with Travel by Theresa, you consent to the exclusive jurisdiction and venue of the courts in Monmouth County, New Jersey, for any disputes arising from or related to your travel bookings. Any claims against Travel by Theresa must be filed within 6 months of the trip's completion; claims filed after this period will not be considered. Travel by Theresa’s liability is limited to compensatory damages only, and you waive any right to seek punitive or exemplary damages.

You agree to bring claims solely in your individual capacity and not as a plaintiff or class member in any class action, proposed or purported class action, or other representative action, regardless of the nature of the proceeding. You expressly waive and relinquish any rights to participate in or initiate any such class actions, purported or proposed class actions, or representative actions.

If any part of these Terms and Conditions is determined to be invalid or unenforceable pursuant to applicable law including, but not limited to, the warranty disclaimers and liability limitations set forth above, then the invalid or unenforceable provision will be deemed superseded by a valid, enforceable provision that most closely matches the intent of the original provision and agreement shall continue in effect.
